Trademarks are essential for protecting your brand and preventing others from infringing by using similar names or logos that could confuse consumers. If you have a unique name (text), logo (graphic), or a combination of both that you want to protect, please read further to understand the procedure for trademarking a name. In this post, we will guide you through the steps for trademarking a name, business name, or logo.

Step 1 is to determine whether your trademark is eligible for trademark.   Not all names and logos can be trademarked. To qualify for a trademark, your name must be unique and not descriptive of the product or service.  For example, I am holding a pen so you cannot trademark ‘Pen” to sell pens because it describes the product for sale.  Moreover, your trademark should not infringe upon any existing trademarks. Consult with a trademark attorney to ensure your name meets the eligibility requirements.

Step 2 is to do product research and trademark research: Before applying for a trademark, it’s important to research if your desired trademark is already in use by another company. Conduct a thorough search on Amazon, Walmart or stores where your similar product or service is sold.  In addition, do a trademark search at the United States Patent and Trademark Office (USPTO website to check for existing trademarks that may have been filed before yours.

3. Prepare to file a trademark application. Once you have determined the eligibility of your name and that you have a green light compared to prior trademarks, it’s time to prepare the necessary documentation. This includes completing the trademark application form, providing a description of the goods or services associated with the name, and submitting any required fees.

4. File the Application. Submit your trademark application through the USPTO website. Make sure to double-check all the information and attach any additional supporting documents, such as a specimen of how the trademark will be used in commerce to sell your products or services.
